Important Information for Nominees

 

If you hold shares of Evoqua common stock purchased between November 1, 2017 and October 29, 2018, inclusive, as a nominee for a beneficial owner, then, within FOURTEEN (14) DAYS OF YOUR RECEIPT OF THIS NOTICE, you must either: (a) send a copy of the Plan Notice and Proof of Claim by first class mail to all such beneficial owners; or (b) provide a list of names and addresses of such Persons to the Distribution Agent.

If you choose to follow procedure (a), an unlimited number of Plan Notices and Claim Forms are available online for download and print by the Nominees or Custodians. In the event paper copies are needed, the Distribution Agent may provide no more than 50 additional copies of the materials relevant to submitting a claim to any Nominee or Custodian requesting it for the purpose of distribution to beneficial owners.

Regardless of whether you choose to complete the mailing yourself or elect to have the mailing performed for you, you may obtain reasonable reimbursement for, or advancement of, reasonable administrative costs actually incurred or expected to be incurred in connection with forwarding the Notice and which would not have been incurred but for the obligation to forward the Notice, upon submission of appropriate documentation to the Distribution Agent.  If you choose to forward the Claims Packet yourself, the Commission has directed that you send a statement to the Distribution Agent confirming that you made the mailing as directed.

 

If you are providing a list of names and addresses to the Distribution Agent:

  1. Compile a list of names, mailing addresses, and, if available, email addresses of the beneficial owners who purchased or otherwise acquired Evoqua common stock between November 1, 2017 and October 29, 2018, inclusive.
  2. Prepare the list in Microsoft Excel format. A preformatted spreadsheet for your use can be found online here: Download Preformatted Spreadsheet
  3. Then you must do one of the following:
    1. Upload the spreadsheet online: Upload Spreadsheet (preferred);
    2. Email the spreadsheet to: info@EvoquaFairFund.com.
    3. Burn the Microsoft Excel file(s) to a CD or DVD and mail the CD or DVD to: Evoqua Fair Fund, c/o Analytics Consulting LLC, Distribution Agent, P.O. Box 2007, Chanhassen, MN 55317-2007.

If you are mailing the Settlement Claims Packet to beneficial owners:

If you elect to mail the Claims Packet to beneficial owners yourself, up to 50 additional copies may be requested via email to info@EvoquaFairFund.com. As noted above, you must forward the Claims Packet to the beneficial owners within fourteen (14) days of your receipt of the packets.
